Blanket Loft makes personalized blankets from designs we create or license and from photos and text our customers send us. We take copyright seriously on both sides of that: we do not want to print someone else’s work without permission, and we want artists, photographers and illustrators to have a clear, quick way to tell us if something on blanketloft.com uses their work. This page explains how to send a copyright notice, what we do with it, and how a customer can respond if their content was removed by mistake. Trademark and other intellectual property concerns are covered by our Intellectual Property Policy.

1. What this page covers

This process applies to any material on blanketloft.com or produced by Blanket Loft, including:

  • blanket designs, patterns, illustrations and lettering shown on product pages;
  • product photographs, lifestyle images and graphics on the site;
  • product descriptions, guides and other text;
  • content submitted by customers that appears on the site, such as review photos;
  • customer-supplied photos or artwork used to make a personalized blanket that has not yet been made or shipped.

It follows the notice-and-takedown procedure of the United States Digital Millennium Copyright Act (17 U.S.C. § 512). Rights holders in Canada, Australia and New Zealand may use the same process; we respond to notices under those countries’ copyright laws in the same way.

2. Before you send a notice

A quick check can save time on both sides. Please confirm that the material is really yours or your client’s, and consider whether the use might be permitted, for example a short quotation, a parody, or a design that only shares a common idea (such as a paw print or a family tree) rather than copying your specific artwork. Copyright protects a particular expression, not a general theme. If you are unsure, you may want to take legal advice before sending a formal notice, or simply email us informally first: many concerns are resolved by a conversation.

3. What a copyright notice must include

Under 17 U.S.C. § 512(c)(3), your written notice must include:

  1. A physical or electronic signature of the copyright owner or of a person authorized to act on the owner’s behalf. A typed full name at the end of an email is accepted as an electronic signature.
  2. Identification of the copyrighted work you believe has been infringed, for example a link to your original illustration, the title of the photograph, or a registration number if you have one.
  3. Identification of the material on our site that you believe infringes, with enough detail for us to find it: the exact URL of each product page or image, and a description of which part of the design is affected.
  4. Your contact details: name, postal address, telephone number and email address.
  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner’s behalf.

Send the notice by email to support@blanketloft.com with the subject line “Copyright notice”, or by post to Blanket Loft, 1806 E. Sequoia Trail, Sioux Falls, SD 57103, United States. Email is much faster. If a notice is missing elements, we will tell you what is missing; we may not be able to act until it is complete.

4. What we do when we receive a notice

When we pass a notice on to a customer, we share its substance so they can understand and respond. Where the law allows, we withhold your personal contact details unless the customer sends a counter-notification, in which case the law requires that the parties can contact each other.

5. Customer photos and artwork used for personalized blankets

Most customer content never appears on our site: it is used privately to make one blanket. Our Terms of Service require customers to own, or have permission to use, every photo and piece of artwork they send. If you believe a customer has sent us your work to print, for example a professional photograph or a commissioned pet portrait, tell us with as much detail as you can. We cannot reveal other customers’ orders to you, but we will check our open orders, and if we find your work we will not print it without evidence of permission.

We also look over uploads for obvious problems before production. We decline images that contain watermarks from photographers or stock libraries, and artwork showing well-known characters or logos.

6. Counter-notification

If content you submitted was removed and you believe that was a mistake or a misidentification, for example because it is your own photograph or you hold a license, you may send a counter-notification to the same address. It must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of a mistake or misidentification.
  4. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or, if you are outside the United States, any judicial district in which Blanket Loft may be found), and that you will accept service of process from the person who sent the original notice or their agent.

We forward a valid counter-notification to the person who sent the original notice. If they do not tell us within 10 business days that they have filed a court action to restrain the activity, we may restore the material within 10 to 14 business days after receiving the counter-notification.

7. False or misleading notices

Under 17 U.S.C. § 512(f), anyone who knowingly makes a material misrepresentation that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys’ fees. Please make sure your notice or counter-notification is accurate.

8. Repeat infringement

We will not accept further orders from customers who repeatedly send us content that infringes other people’s copyright, and we remove content and may close accounts in appropriate circumstances.

9. Situations we see with blankets

Commissioned pet and family portraits

Many customers commission a digital portrait of their pet or family from an independent artist and then want it on a blanket. Buying a portrait does not always include the right to reproduce it on products. If you send us a commissioned portrait, we may ask you to confirm that the artist allows printing. Artists who find their portrait in one of our product listings can use the notice process above.

Professional photographs

Wedding, newborn and family photos taken by a professional photographer often come with a print release that covers personal printing; some do not. Customers should check their release before ordering. Photographers who believe their work has been sent to us without permission can contact us as described in section 5.

Poems, quotes and song lyrics

Short phrases and names are generally not protected by copyright, but whole poems and song lyrics usually are. We print famous lines only when they are in the public domain or the customer confirms they hold permission, and we decline song lyrics without a license. Writers and publishers who see their text on our site can send a notice.

Watermarked or downloaded images

Images saved from search engines, social media or stock photo sites frequently belong to someone else. We do not print images that carry a visible watermark, and we ask customers to use their own photos.

Fonts and lettering styles

We choose name lettering only from fonts whose licenses allow use on products, and we check this when a design is added. Customers cannot upload their own font files, which avoids printing a typeface outside its license. If you design typefaces and believe one of yours appears on our products without a license, please send a notice identifying the font and the product pages concerned, and we will check our licenses within the same 5 business days.

10. Notices sent by agents and licensors

Lawyers, licensing agencies and brand-protection services may send notices on behalf of rights holders. Please state who you represent and confirm your authority in the notice. If you send notices for many works, a spreadsheet listing each original work and each URL on our site is the quickest way for us to process them together.

11. Records we keep

We keep a copy of every notice and counter-notification, the steps we took and the dates, for at least 3 years. This lets us identify repeat problems, answer follow-up questions and show that we acted properly. These records are handled under our Privacy Policy.

12. Our own designs

If you see Blanket Loft designs, photographs or text copied on another website or marketplace, we would be grateful if you let us know. Send the link to support@blanketloft.com. We do not offer rewards, but we do follow up.
